USE OF THE NOKKEL APP, HOUSE PRICE INDEX AND WEBSITE

These terms of use (together with any documents referred to in them) set out the terms and conditions (“Terms”) on which you (“you”, “your”) may access and make use of the Nokkel mobile application (the “App”), House Price Index (the “Index”) or this website (the “Website”), and the information, content, features, and services provided through the App, House Price Index and the Website (together, the “Services”).

For the purposes of these Terms, all references to the App, Website or House Price Index shall be deemed to include the other Services unless stated otherwise.

Acceptance of Terms

By accessing or using the Services you accept these Terms and agree to abide by them. If you do not agree to these Terms, you should not use the Services. Your right to access the Services is conditional upon compliance with these Terms. These Terms apply to both Registered Users (as defined below) and unregistered users.

1. 2. Definitions The following definitions apply in these Terms:

  • Intellectual Property Rights: Rights including patents, copyrights, trademarks, trade secrets, and all similar rights globally.

  • Notifications: News, updates, or announcements sent via the App or posted on the Website or House Price Index.

  • Property: Any UK-based property featured on the App or House Price Index.

  • Registered User: A person who has created an account on the App or House Price Index.

  • Third Party Sites: Websites or applications operated by third parties.

3. Purpose of the App and Website The App enables users to browse property details using the interactive map, create a “wish list” of properties they are interested in, and obtain valuation and other information regarding those properties. Some of these features will only be available to Registered Users. The Website describes the Services and provides updates on Nokkel to visitors. The House Price Index shows how median house prices have changed over a (user specified) time period at a local level.

4. Additional Terms 4.1 App Store Rules
The use of the App may be subject to rules and policies from third-party app stores, which take precedence over this policy where applicable.

4.2 Privacy Policy
Nokkel’s Privacy Policy applies to the Services, and can be accessed via the App and Website.

5. Registration 5.1 Eligibility
Registered Users must be at least 18 years old. By registering, you confirm compliance with all applicable laws and acceptance of these Terms.

5.2 Account Creation
Registration requires an email and password (or third-party authentication). Additional information may be requested to customize profiles.

5.3 User Responsibilities
By registering, you agree to:

  • Provide accurate, current, and complete information.

  • Maintain confidentiality of your password.

  • Notify Nokkel immediately if unauthorized access is suspected.

  • Accept responsibility for all activity under your account.

5.4 Account Deactivation
You may deactivate your account at any time by contacting Nokkel.

6. Licence You are granted a limited, non-exclusive license to use the App, Website, House Price Index and Services for personal, non-commercial purposes, subject to these Terms.

7. Accessing the App, Website, House Price Index and Services Access is temporary and may be modified or discontinued at any time. Nokkel does not guarantee uninterrupted or error-free functionality. Users are responsible for ensuring compatible devices and operating systems.

8. Updates and Changes Nokkel may update the App, Website, House Price Index or Services for any reason, including but not limited to improving functionality or addressing security issues. In relation to the App, Users must install updates to ensure continued use.

9. Fees The App, Website, House Price Index and Services are currently free of charge. If fees are introduced for certain features, Nokkel will notify users in advance.

10. Acceptable Use Users must not:

  • Engage in unlawful, harmful, or malicious activities.

  • Infringe on Nokkel’s Intellectual Property Rights.

  • Submit inaccurate or offensive content.

  • Use the App, Website, House Price Index or Services for commercial purposes or unauthorized access.

Nokkel reserves the right to remove inappropriate content or Users who fail to adhere to the above.

11. Notifications Users can subscribe or unsubscribe from notifications at any time. Nokkel is not liable for any third-party content within notifications.

12. Suspension and Termination Accounts may be suspended or terminated for breaches of these Terms. Nokkel reserves the right to remove or block any content or Users violating these Terms.

13. Intellectual Property Rights All Intellectual Property Rights associated with the App, Website, House Price Index or Services are the exclusive property of Nokkel. Users may not:

  • Copy, reproduce, or distribute Nokkel content without consent.

  • Reverse engineer or create derivative works.

14. User Content Users grant Nokkel a license to use submitted content for delivering and improving Services. Inappropriate content should be reported to Nokkel immediately using the contact details above.

15. Third Party Sites The App, Website, House Price Index or Services may contain links to independent third-party sites. Nokkel is not responsible for their content or practices.

16. Liability Nokkel’s liability is limited to what cannot be excluded by law. Nokkel is not liable for:

  • Indirect or unforeseeable losses.

  • Business-related losses.

  • User actions involving property listings.

17. Data Protection Nokkel processes personal data in compliance with applicable data protection laws. For details, refer to Nokkel’s Privacy Policy.

20. Other Terms These Terms may be updated periodically. Users cannot transfer rights or obligations under these Terms without the written consent of Nokkel.

21. Governing Law These Terms are governed by the laws of England and Wales, and any disputes in relation to them, the Website, App or Services will be subject to the jurisdiction of the courts of England and Wales.
